Supreme Court Dismisses Minister’s Appeal in Zimbabwean Exemption Permit Case

The Supreme Court of Appeal (SCA) has dismissed, with costs, an appeal by Home Affairs Minister Dr. Leon Schreiber against interim relief granted to the Zimbabwe Immigration Federation (ZIF), which represents over 1,000 Zimbabwean Exemption Permit (ZEP) holders.
The ruling upholds a June 2023 decision by the Pretoria High Court, which issued an interim interdict preventing government authorities from arresting or deporting ZEP holders.
This legal battle comes amid ongoing uncertainty about the future of the ZEP. The decision on whether to terminate the permit now rests with Minister Schreiber, following a separate court victory by the Helen Suzman Foundation. The High Court has instructed the minister to consult with affected ZEP holders and other relevant stakeholders.
The current ZEP arrangement remains in effect until 28 November 2025, allowing time for these consultations to take place.
